5101:2-48-04 AdoptOhio grant agreement.

(A)      An AdoptOhio grant agreement is an agreement between the Ohio department of job and family services (ODJFS) and the public children services agency (PCSA) or the private child placing agency (PCPA) under which the department makes payments, pursuant to section 5103.12 of the Revised Code, to encourage the adoptive placement of children in the permanent custody of a public children services agency.


(B)      Upon the effective date of this rule, ODJFS will enter into an AdoptOhio grant agreement with a PCPA, or private non-custodial agency (PNA) solely to provide incentive payments for finalization and postfinalization services rendered to families for children who were placed under AdoptOhio grant agreements on or before June 30, 2003 and whose adoptions are finalized before July 1, 2004. According to the terms of the AdoptOhio grant agreement, incentive payments shall be made to agencies for these finalization and postfinalization services, as follows:


(1)      For a child placed for adoption on or before June 30, 2003, and for whom there is a final decree of adoption issued on or before April 1, 2004, the agency shall provide or arrange to provide postfinalization services for three months after finalization at no cost to adoptive families.


(2)      For a child placed for adoption on or before June 30, 2003 and for whom there is a final decree of adoption issued on or after April 2, 2004 and before June 30, 2004, the agency will provide or arrange to provide postfinalization services under the AdoptOhio grant agreement through June 30, 2004 at no cost to the adoptive family. The agency will be eligible to receive prorated payments for finalization services provided on or before June 30, 2004 according to the AdoptOhio grant agreement.


(C)      ODJFS will not enter into an AdoptOHIO grant agreement with a PCSA, PCPA, or PNA for any child placed for adoption after June 30, 2003.


(D)      The agency shall not charge families for any application or homestudy services that were completed for a waiting child as defined by rule 5101:2-1-01 of the Administrative Code which were rendered on or before June 30, 2003 under the AdoptOhio grant agreement. If after June 30, 2003 a family adopts a child who is not a waiting child, the agency may charge the family for application and homestudy services which were rendered on or before June 30, 2003.


(E)      The AdoptOhio grant agreement funds are contingent on appropriations made by the Ohio general assembly. If the Ohio general assembly fails at any time to continue funding ODJFS for these payments, the AdoptOhio grant agreements are terminated as of the date funding expires without further obligation of ODJFS or the state of Ohio.
