5101:2-39-08  Requirements for PCSA case plan for in-home supportive services (no court order).

     (A) The PCSA shall develop and complete a case plan utilizing the ODJFS 01444, "Family Decision Making Model, Part II: Case Plan" when in-home supportive services are being provided or need to be provided to the child and his parent, guardian, or custodian and there is no court order.

     (B) The ODJFS 01444 shall be based on the assessment of risk to the child and any additional information obtained.

     (C) The PCSA shall develop and complete the ODJFS 01444 within thirty days after but never longer than sixty days after the PCSA has determined either the case resolution indicates the need for services or the parent, guardian, or custodian has agreed upon the provision of supportive services.

     (D) The PCSA shall provide the child's parent, guardian, or custodian with an opportunity to participate in the development and review of the ODJFS 01444. The PCSA shall obtain agreement on the contents of the ODJFS 01444, attempt to obtain signatures from the child's parent, guardian, or custodian and provide each with a copy of the ODJFS 01444.

     (E) The PCSA shall complete an amendment to the ODJFS 01444 when there is a change in services, visitation or placement with the child pursuant to paragraph (F) of this rule.

     (F) The PCSA shall contact the child's parent, guardian, or custodian and seek an agreement for an amendment of the ODJFS 01444, when any of the following occurs:

     (1) Changes in the conditions of the child and his parent, guardian, or custodian are affecting the provision of supportive services;

     (2) Review of the risk assessment and/or ODJFS 01444 has resulted in a change in risk to the child; or

     (3) The child is placed in an out-of-home care setting.

     (G) When a PCSA is providing in-home supportive services with no court order, the PCSA may implement the amendment to the ODJFS 01444 once the parent, guardian, or custodian has agreed to the change. The PCSA shall attempt to obtain signatures of the parent, guardian, or custodian for amendments.

     (H) When the PCSA and the parent, guardian, or custodian can no longer agree on the ODJFS 01444, the PCSA shall:

     (1) Discontinue supportive services to the family; or

     (2) If the child is an abused, neglected, or dependent child, or is threatened to become abused, neglected or dependent, and intervention of the court is needed for the child's protection, the PCSA shall file a complaint with the court pursuant to rule 5101:2-42-04 of the Administrative Code.

     (I) The PCSA shall conduct a semiannual administrative review no later than six months after the date the original ODJFS 01444 was completed for in-home voluntary supportive services and subsequent reviews pursuant to rule 5101:2-42-43 of the Administrative Code.

     (J) When a semiannual administrative review results in a recommendation for an ODJFS 01444 amendment, the PCSA shall provide the child's parent, guardian, or custodian with an opportunity to participate in the amendment.

     (K) The purpose of reviewing the ODJFS 01444 is to ensure that continued efforts are being made to:

     (1) Evaluate whether risk to the child has been lowered or there is increased risk to the child;

     (2) Evaluate the effectiveness of supportive services offered and provided to the child and his parent, guardian, or custodian;

     (3) Prevent placement of the child in an out-of home care setting.

     (L) At any time the PCSA determines a child is at imminent risk of harm, the PCSA shall do one or more of the following:

     (1) Immediately develop and complete, pursuant to rule 5101:2-34-37 of the Administrative Code, an ODJFS 01510, "Family Decision Making Model, Safety Plan for Children";

     (2) Contact law enforcement;

     (3) Take immediate steps for the emergency removal of the child pursuant to rule 5101:2-39-12 of the Administrative Code.

     (M) Case closure shall occur once it is indicated that the overall level of risk has been reduced, the PCSA has determined the case may be closed or the court has ordered the case closed, the principals of the case have been notified and a case plan amendment cover sheet has been completed and signed by the PCSA.

     (N) The PCSA shall maintain a copy of the original ODJFS 01444 and all amendments in accordance with rule 5101:2-39-02 of the Administrative Code.

     (O) The PCSA may choose to convert the ODJFS 01444 to a horizontal format. The ODJFS 01444 language, ranked order of sections, and the order of elements contained within the sections shall not be altered during the conversion process.
